Bail explained: regular and anticipatory bail in plain language

Few words cause as much anxiety as "arrest". Understanding bail in advance makes the first hours calmer and the decisions clearer.

What bail is

Bail is the temporary release of an accused person while the case is pending, usually on conditions. It is not a finding on guilt or innocence. Courts consider factors such as the seriousness of the allegation, the likelihood of the accused appearing for trial, and the risk of interference with evidence or witnesses.

Regular bail

Regular bail is sought after a person has been arrested. The application is made to the competent court, and the accused remains in custody until it is decided.

Anticipatory bail

Anticipatory bail is sought in advance, when a person has reason to believe they may be arrested on an accusation of a non-bailable offence. If granted, it operates as protection from arrest, subject to conditions.

What to do in the first hours

  • Stay calm and cooperate courteously with the authorities.
  • Do not sign anything you have not read or do not understand.
  • Speak to an advocate before giving any detailed statement.
  • Keep copies of every notice, summons and document you receive.
